The present general terms of sale have for subject to govern the contractual relations between Galerie Fayet and the customer defined below as being the user of the website and accepting the present General terms of sale.

As a result, all order made involves the full and whole membership to the present General terms of sale. Any other terms commit the Cannes Fayet S.E only after written confirmation of its part. The information appearing on this site is given only as a rough guide and can be modified by Galerie Fayet without notice.

Products

Goods which we sell are described, presented, and photographed with the biggest accuracy. If in spite of all our precautions, an error occurred, the responsibility of Galerie Fayet could not be committed.

Period of validity of offers to sell

Products are proposed in the sale while stocks last. For products which are out of stock in our warehouse, our offers are valid subject to availability of raw materia from our suppliers l. In case of order of an unavailable product, the customer will be informed by email as soon as possible.

Price of products

The prices appearing on the site boutique-cannes-fayet.com  are in Euro and all taxes included, except transport cost. They can be modified at any time and without notice. At this price, it is advisable to add the transport costs calculated according to the type of ordered articles. The cost are specified on the screen at the end of selection of the different products, and are reminded in the summary of the order before the validation.

The price is payable cash the day of the order. The practiced prices are the ones applied at the time of the order according to available stock and subject to typographical error or to modification of the rate of French VAT (or of change of status of the company). Any change of this rate would be echoed then immediately on the sale prices.

Except European Union or in FRENCH OVERSEAS DEPARTMENTS AND TERRITORIES, and according to the legislation in force in the area of delivery, customs charges and fee and taxes can be demanded by these areas to the customer.

Order

If the customer wants to place an order, he should be identified in prior. For that purpose, he will fill in a form on-line, according to the indications which are supplied on-line. He will write the information necessary for his identification in particular his name, first name, phone number, mail and electronic addresses, addresses for invoice and delivery. Then, some other information can be asked him to ensure the quality and the safety of the delivery. All the information is presented to the customer in French language.

After the customer have chosen the presented products, will validate definitively his order by clicking the button “Confirm order” to show its commitment and its acceptance of General terms of sale. At this moment, the order is recorded and a confirmation is communicated to the customer in the screen and/or by e-mail. The data recorded by Cannes Fayet S.E. makes the proof of the nature, the contents and the date of the order.

No unilateral cancellation of order will be accepted without the agreement of Galerie Fayet If nevertheless, the customer cancels his order, the consideration of the cancellation will give rise to a compensation fixed to 10 % of the amount inclusive of tax of the order and to the acquisition of the paid deposits.

Delay of delivery

The delay of delivery can vary according to the availability of products. This one can vary very fast according to the level of sales. The maximum deadline of delivery noticed does not exceed 10 working days.
In case of major force or of exceptional events (natural disaster, epidemic, strikes, lockout, etc.) delaying or forbidding the delivery of the goods, Cannes Fayet S.E is released from any responsibility. In every case, the delivery in deadline can take place only if the customer is up to date of his obligations to Galerie Fayet.

Cannes Fayet S.E cannot be held responsible of the variation of the stock and thus the availability of stocks.

Complaint

We remind you that according to the legislation in force, the goods travel at the risks and the dangers of the addressee, even if it is postage paid sent. The customer has the obligation to verify the conformity and the good state of the goods at the delivery. It is up to the Customer to make all the reserves with the carriers and to exercise any appeal against third parties. Galerie Fayet does not take the responsibility in the case of damage, break-in, deterioration or loss during the transport.

Any complaints relative to a defect of the delivered goods, to an inaccuracy in the quantities or to an erroneous reference with regard to the order confirmed by Galerie Fayet, must be formulated in writing within three days upon receipt of the goods failing which the right for the complaint will stop being acquired. Any return of goods requires the preliminary agreement of Galerie Fayet. If the agreement is not available, any returned goods will have at the disposal of the Customer at his expenses, risks and dangers, any costs of transport, storage, handling being chargeable to the customer. In every case, the return of the goods is made at expenses, risks and dangers of the Customer. Cannes Fayet S.E is not forced to compensate or to cancel an order further to the impossibility to use the product bought for a reason of incompatibility with the material already possessed by the Customer.

Payment terms

The customer can pay with different way :

  • Payment with bank transfer

  • Payment with a french cheque/check until 500€

The customer can order directly on the website galerie-fayet.com. Then he should send the cheque by mail with Name, order’s number and details of the order à the following address :

If we have not received any payment within 10 days, the order will be canceled.

The customer’s account is debited of the amount of product and transport cost as soon his order is ready.

Guarantee and after-sales service 

This guarantee does not cover the damage resulting from accidents, from misuse or from negligence. According to products and the date of purchase, Galerie Fayet take charge of the repair. In case of return of an article not defective, cost of transport, handling and tests can be charged to the Customer.

Any return of goods requires the preliminary agreement of Galerie Fayet in order to have a number of return, which must be very legibly wrote on each returned parcel. The return of the goods is made at expenses, risks and dangers of the customer.  Returned products  with carrier and without or badly protected cannot benefit from the guarantee, it is thus up to the customer to watch to protect and to assure one or several returned products during their transport.

It is up to the customer to keep packaging, accessories supplied with the product as well as the possible labels affixed on the product or its packaging, and which are necessary to benefit from the offered guarantee.

Galerie Fayet will watch to apply the guarantee to any returned product as soon as possible. On the other hand, the after-sales service of Galerie Fayet will choose the carrier asked to deliver the goods to the customer.

Complete satisfaction guarantee

For all special order: specific manufacturing, and cane put in length require by the client will be not taken back.

Galerie Fayet makes a commitment if whatever reason it is, the customer was not completely satisfied by one of our products, he can return it. As from the delivery date of his order, the customer has a deadline of 7 days to exploit his right of revocation, and be paid off. However incomplete, used, damaged or made dirty products are not taken back. As for quite other return of the goods, the customer will beforehand have to obtain a number of return by Galerie Fayet.

Additional costs of handling, tests and reconditioning can be charged to you.

Property reserve and responsibility

Cannes Fayet S.E keeps the property of the goods until their complete payment from the customer. Ownership transfer of products to the customer is made at the time of the complete payment of the price. However, during period of the delivery in ownership transfer, the risks of losses, thefts or destruction are chargeable to the customer.
